Terms of Service

1. Acceptance

By visiting this website, joining the waitlist, or using the AutoPings platform (the "Service"), you agree to these Terms of Service. If you are agreeing on behalf of a company, you confirm you have authority to bind that company, and "you" means that company.

2. Eligibility

You must be at least 16 years old and legally able to enter a contract. The Service is intended for business use, not for personal or household purposes.

3. The waitlist and pre-launch access

Joining the waitlist does not create a contract for the Service, does not guarantee access, and does not lock in pricing except where we state it explicitly — for example founding pricing for the first 100 signups, subject to eligibility and to you activating an account when invited. Pre-launch and beta features are provided "as is" and may change or be withdrawn without notice.

4. Accounts and workspaces

You are responsible for the accuracy of your account details, for keeping credentials confidential, and for all activity under your account. Workspace owners control who they invite and what role each member holds, and are responsible for the actions of their members. Tell us promptly at security@autopings.com if you suspect unauthorised access.

5. Acceptable use

You agree not to use the Service to:

• send unsolicited bulk messages, spam, or messages to recipients who have not consented where consent is required;
• violate messaging-platform policies (including WhatsApp, SMS carrier, Slack, and Discord rules) or applicable law such as GDPR, CAN-SPAM, or TCPA;
• send unlawful, deceptive, harassing, or infringing content;
• upload malware, probe or breach security, or attempt to access another workspace's data;
• reverse engineer, resell, or scrape the Service except as permitted by law or an agreed white-label arrangement;
• place an unreasonable load on the Service or circumvent usage limits.

We may suspend access without notice where use threatens the Service, other customers, or compliance with law.

6. Your content

You keep all rights to the messages, documents, and data you put into AutoPings. You grant us a limited licence to host, process, transmit, and display that content solely to operate and support the Service on your behalf. You are responsible for having the rights and consents needed for the content you send through the Service.

7. Our intellectual property

AutoPings, its software, design, documentation, and brand remain our property. Nothing in these terms transfers ownership. Feedback you send us may be used freely without obligation to you.

8. Third-party services

The Service connects to third-party platforms you choose, such as messaging channels, storefronts, and AI providers. Your use of those platforms is governed by their own terms, we do not control them, and we are not responsible for their availability, pricing, or policy changes.

9. Fees

Pricing is announced at launch. Once paid plans begin, fees are stated at the point of purchase, charged in advance for the billing period, and non-refundable except where required by law. Taxes are your responsibility. We will give at least 30 days' notice before a price change affecting your subscription.

10. Availability and support

We aim for high availability but do not promise uninterrupted service during pre-launch. Maintenance, third-party outages, and beta instability may cause downtime. Any formal service-level commitment will be a separate written agreement.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated drafts and automations may be inaccurate; you are responsible for reviewing what your business sends to customers.

12. Limitation of liability

To the maximum extent permitted by law, AutoPings is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data. Our total aggregate liability arising from the Service is limited to the greater of the fees you paid us in the 12 months before the claim, or USD 100. Nothing here excludes liability that cannot lawfully be excluded.

13. Indemnity

You will defend and indemnify AutoPings against third-party claims arising from your content, your use of the Service, or your breach of these terms or of applicable law.

14. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access for material breach, unlawful use, or non-payment, with notice where reasonable. On termination your right to use the Service ends; you may export your data for 30 days, after which it is deleted in line with our Privacy Policy .

15. Changes to these terms

We may update these terms as the product evolves. The "last updated" date reflects the current version, and we will notify account holders by email before material changes take effect. Continued use after that date means you accept the revised terms.

16. Governing law

These terms are governed by the laws of the jurisdiction in which AutoPings is established, without regard to conflict-of-law rules, and the courts of that jurisdiction have exclusive jurisdiction over disputes. Nothing prevents either party from seeking injunctive relief where appropriate.
